As the trial looms, Cardi is actively pursuing the dismissal of multiple claims, including false imprisonment and violation of the Bane Act, in an effort to streamline the legal proceedings.
The lawsuit, brought forth by security guard Emani Ellis, alleged that Cardi B physically assaulted her when she requested a photo with the rapper. Ellis further claimed that Cardi used racial slurs and profanities during the incident, resulting in her termination from her job. Cardi vehemently denied all allegations.
According to Radar Online, Cardi’s legal team is specifically targeting the dismissal of the false imprisonment claim, arguing that it was filed beyond the statute of limitations. The motion contends that Ellis should have initiated the claim within one year of the alleged incident in February 2018, but the lawsuit was filed in February 2020.
The second claim under scrutiny involves Ellis asserting that Cardi interfered with her constitutional right to engage in legitimate employment. In response, Cardi’s lawyer counters that Ellis has not adequately demonstrated how Cardi, being an entertainment celebrity and not a state actor, could legally violate any constitutional rights.
With the trial scheduled to begin on February 1, Cardi B has also previously sought the court’s intervention to exclude testimony about her net worth as evidence and to preclude any mention of past altercations with third parties during the proceedings.
